Agreement

These Terms of Use govern your access to and use of the ariasurf website and services ("the service"). By using the service, you agree to these terms. If you do not agree, do not use the service.

Acceptable Use

When you use the service, you agree not to:

• Scrape, crawl, harvest, or otherwise extract data from the service by automated means, including bots, spiders, and scripts, without our prior written permission

• Use any part of the service, including forecasts, ratings, and articles, to train, fine-tune, or feed machine learning or artificial intelligence models

• Copy, republish, resell, sublicense, or redistribute the forecasts or other content of the service, in whole or in substantial part, or build a competing product or service with it

• Reverse engineer, decompile, or try to access the source code, APIs, or internal systems of the service, except where the law expressly allows it

• Interfere with or disrupt the service, overload its infrastructure, or bypass any rate limit, access control, or security measure

• Create accounts by automated means, share your account, or use another person's account without permission

• Use the service for any unlawful purpose or in violation of these terms

Intellectual Property

The service and its content, including the design, text, articles, ratings, graphics, logos, and software, belong to ariasurf or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the service for your own non-commercial purposes. Some forecast and map data comes from third-party providers, credited on our Credits page, and stays subject to their own licenses.

Accounts

You are responsible for the information you give us, for the security of your account, and for all activity under it. Tell us immediately if you believe someone used your account without permission.

Pro Subscriptions

Pro subscriptions renew automatically at the end of each billing period until you cancel them. You can cancel at any time from your settings, and the cancellation takes effect at the end of the current period. Stripe processes the payments. Except where the law requires otherwise, payments are not refundable. We can change the prices, and we tell you before a change applies to your subscription.

Forecasts and Safety

Forecasts, ratings, and articles are estimates for information only. They can be inaccurate, incomplete, or out of date, and ocean conditions can change quickly. Do not rely on the service to decide whether it is safe to go in the water. Always check the conditions yourself, respect local warnings and lifeguards, and surf within your own ability. You are solely responsible for your safety and your decisions.

Disclaimer of Warranties

We provide the service "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, secure, or free of errors.

Limitation of Liability

To the maximum extent that the law allows, ariasurf is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any injury, loss of life, property damage, or loss of data or profits, that comes from your use of the service or your reliance on its forecasts. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

Indemnification

You agree to defend and indemnify ariasurf against any claim, damage, or expense that comes from your breach of these terms or your misuse of the service.

Suspension and Termination

We can suspend or close your account, or block your access to the service, at any time and without notice, if you break these terms or if we believe your use harms the service, other users, or us. You can stop using the service and ask us to delete your account at any time.

Changes to These Terms

We can update these terms. A change becomes effective when we publish the updated terms on this page, and we also change the "Last updated" date. If you keep using the service after a change, you accept the updated terms.
